République numérique : conditions de l'enseignement supérieur à distance
Conformément à la loi du 7 octobre 2016 pour une République numérique, les enseignements délivrés par les établissements d'enseignement supérieur peuvent être dispensées soit en présence des usagers, soit à distance, le cas échéant, sous forme numérique, soit selon des dispositifs associant les deux formes.
Un volume minimal d'enseignement pédagogique, fixé par voie réglementaire, peut être assuré en présence des étudiants.
L'enseignement à distance doit être totalement ou majoritairement conçu et organisé par des enseignants de l'établissement et être assorti d'un accompagnement personnalisé des étudiants.
Chaque établissement doit arrêter les conditions de la validation des enseignements au plus tard à la fin du 1er mois de l'année d'enseignement, sans les modifier en cours d'année.
La validation des enseignements contrôlée par des épreuves organisées à distance sous forme numérique, doit être garantie par la vérification de l'identité du candidat ; celui-ci devant disposer des moyens techniques lui permettant le passage effectif des épreuves. La surveillance de l'épreuve et le respect des règles applicables aux examens doivent aussi être garanties.
