Chaque année, les entreprises doivent consacrer 23% du montant de la taxe d’apprentissage due à des « dépenses réellement exposées afin de favoriser des formations technologiques et professionnelles dispensées hors du cadre de l’apprentissage ». Cette catégorie de dépenses est communément appelée la fraction "Hors quota".
Les organismes agissant au plan national pour la promotion de la formation technologique et professionnelle initiale et des métiers peuvent être éligibles au titre de la fraction « Hors quota » de la taxe d’apprentissage.
Pour cela, les ministères chargés de l’éducation nationale et de la formation professionnelle arrêtent chaque année une liste nationale de ces organismes, éligibles au bénéfice de la fraction « Hors quota » de la taxe d’apprentissage (6° de l’article L.6241-10 du code du travail).
Pour l’année 2017, les organismes souhaitant déposer une demande en vue de leur inscription sur cet arrêté peuvent adresser leur dossier, au plus tard le 06 octobre 2016, à l’adresse suivante : dgesco.ta.liste.nationale@education.gouv.fr.
En vue de la sélection des organismes, les dossiers seront instruits conjointement par les ministères chargés de l’éducation nationale et de la formation professionnelle.
Le dossier de demande comportera :
Les organismes figurant sur les arrêtés du 24 novembre 2015 et du 14 décembre 2015 et souhaitant figurer sur la prochaine liste nationale compléteront ce dossier par :
Les demandes émanant d’organismes à but lucratif ayant le statut d’établissements privés relevant de l’enseignement supérieur ou concourant, par des actions de formation professionnelle, à offrir aux jeunes sans qualification une nouvelle chance d’accès à la qualification, ne peuvent être recevables.
Les dossiers émanant d’organismes dont l’action pour la promotion de la formation technologique et professionnelle initiale et des métiers ne relève pas du niveau national ne pourront également pas être examinés.
Les actions de promotion permettant de justifier l’inscription sur la liste nationale ne peuvent s’entendre comme des actions de formation, de coopération ou d’étude.
À PROPOS DE LA TAXE D’APPRENTISSAGE
La taxe d’apprentissage, qui est une obligation fiscale dont les entreprises doivent s’acquitter, a pour but de financer le développement des formations technologiques et professionnelles.
On distingue trois quotités au sein de la taxe d’apprentissage :
