The U.S. Supreme Court issued its long-awaited decision yesterday in the second hearing of Fisher v. University of Texas at Austin​ (UT), voting 4-3 to uphold UT’s diversity in admissions policy.

Comments to the Department of Education from ACE and 13 other higher education associations on the Notice of Proposed Rulemaking (NPRM) regarding borrower defenses to repayment published in the Federal Register on June 16, 2016. 
While the associations strongly support the goals of the NPRM, they urge the department to continue to clarify the regulatory language to ensure that it will best serve borrowers, hold fraudulent institutions accountable for their misconduct, and ensure a fair process for legitimate institutions.
