La question du cumul avec un mandat local
Un projet de loi constitutionnelle de 2013 relatif aux incompatibilités applicables à l’exercice de fonctions gouvernementales et à la composition du Conseil constitutionnel prévoyait d’inscrire dans la Constitution l’interdiction du cumul des fonctions de ministre avec un mandat d’exécutif local. Toutefois, ce projet de loi a été abandonné faute d'examen par le Sénat.
Le projet de loi constitutionnelle, présenté le 9 mai 2018 dans le cadre de la réforme des institutions, reprenait cette interdiction dans son article 1er ("Les fonctions de membre du Gouvernement sont également incompatibles… avec l’exercice d’une fonction exécutive ou de présidence d’assemblée délibérante au sein des collectivités…, de leurs groupements et de certaines personnes morales qui en dépendent"). Cette interdiction n'est pas abordée dans le nouveau projet de loi constitutionnelle présenté le 28 août 2019 en conseil des ministres.
